MP HC denies bail to Computer Baba in criminal case, directs to approach right court

The Madhya Pradesh High Court, in its special hearing, has denied granting interim bail to Namdev Das Tyagi (Computer Baba).


He was initially detained for allegations of illegal construction in his Ashram.

The bail hearing was against a case registered by Gandhinagar police for allegedly manhandling a Panchayat Secretary prior to demolition of the construction near the ashram, which was alleged to be illegal.

He was detained under Section 151 of the CrPC for the first case, and the second criminal case was filed under Sections 353, 323, 294, 186, 506/34 of the IPC read with Section 3 of SC/ST Act, 1989.

The Court, with respect to the encroachment of land case, stated that there is already an order directing the petitioner to give the bank guarantee of Rs. 5,00,000/-.

In the criminal case, the Court has ordered,

“So far as the other criminal cases are concerned , the petitioner shall be free to file a bail application under the provisions of the Code of Criminal Procedure at the first instance before appropriate forum.”

It further stated, “The Registry of this Court has informed this Court that in the District Court, a Judicial Officer at the rank of Additional District Judge as well as Chief Judicial Magistrate shall be available tomorrow.

“Therefore, the petitioner shall be free to submit his bail application in respect of other criminal cases and the bail application of the petitioner shall be decided on the same day in accordance with law.”

Justice S C Sharma and Justice Vivek Rusia heard the Habeas Corpus plea filed by Computer Baba.


The Court ordered the petitioner to approach the appropriate forum in
the criminal case.
