IAS officers who defy orders should be jailed: Madras High Court

The Madras High Court, while hearing a petition, said that IAS officers who disobey the orders should be punished with imprisonment.


Justice Vaidyanathan said that imposition of fine should be secondary punishment, while imprisonment should be first.


The petition was filed by one Mathavadiyan asking for directions to the authorities to consider his appeal of making corrections in the entries of his patta.


Justice Vaidyanathan stated that officers ought to adhere to the time allotted while dealing with applications filed under the Tamil Nadu Patta Passbock Act, 1983.


He said that there are several pending applications filed under the beforementioned Act. If the concerned authorities dispose of the applications in time, the Court would need to interfere and hear the grievances.


Justice Vaidyanathan said, “It is not known as to why an order of the Court is required for the authorities to do their job as adumbrated under the Act, for which salary is provided to them.”


Referring to a Madras High Court judge who visited the scene before granting compensation to the electrocuted victim, Justice Vaidyanathan said that government authorities need to do immediate inspection wherever required.


If they cannot, they should be shown doors as they are not deemed to hold the post.
