Rajasthan HC calls for action against Magistrate who issued arrest warrant, disrespecting HC’s existing bail order

The Rajasthan High Court has directed the Registrar of Vigilance to initiate against the Magistrate who issued the arrest warrant, despite the already-existing High Court’s anticipatory bail order.


The Bench of Justice Sanjeev Prakash Sharma said that the Magistrate’s action showed “scant respect to the High Court’s order.”


The Magistrate had issued an arrest warrant against the petitioners and charged them under Sections 418, 420, 465, 467, 471, 406, & 120-B.


However, the High Court had already granted bail to the petitioners, Nanuram Saini and Vinod Kumar, in 2003 relating to the case of cheating.
The High Court said that the actions of the Magistrate were a clear violation of the High Court’s orders.


It further said that the learned Magistrate did not have to “have issued the arrest warrants, and such course or power was not available with it in spite of having been given it.”
