The Supreme Court has dismissed a PIL seeking to allocate separate and adequate funds for the judiciary thereby stating that the court can’t interfere as well as no such directions are required to be given to the governments.
This decision came after the three-judge bench headed by Chief Justice N.V.Ramana who was hearing over the application for restoration of the PIL for allocation of separate funds which was earlier heard and rejected by the former CJI SA Bobde for non-prosecution.
The PIL urged the Court to pass directions to the Central and State governments to allocate separate funds for the judiciary claiming that the governments are not vigilant and do not even consider the Judiciary to be as important as to look into the establishment in the infrastructure of the Judiciary.
The Petition contended that the Judiciary is completely dependent on the government for the allocation of funds and thus claimed that there is a heavy control and influence of the governments in the decisions of the Judiciary in their judgments.
It was further submitted that the Government does not even spend 0.5 % of the budget on the Judiciary and thus it is the need of an hour to have a separate and adequate allocation of funds.
In conclusion, the Bench dismissed the plea and stated that the Judiciary will deal with the issue of allocating funds independently.
