Delhi HC grants Monetary Compensation to ‘Barely Alive’ Electrician

Delhi High Court ordered monetary compensation of 20 lakhs to a young electrician, who became permanently disabled following an incident at his workplace.

The Court also went a step ahead and ordered to open a ‘General Store’ in the name of Bharat from the money received through compensation, planning a stable source of income for him.

Justice Anup Jairam Bhambhani ordered both the contractor and the power distribution company to compensate the victim.

BSES Rajdhani Power Limited (BRPL), who is responsible for distribution of electricity across the certain parts of Delhi and Bryn Construction Company, the contractor has been asked to pay an amount of 10 lakh each, a sum of 20 lakhs, to the victim within four-weeks.

The Court also directed the Uttar Pradesh Government to treat the victim as a person with 100% disability and has asked the State Government to provide him disability pension, free physiotherapy and occupational therapy and other assistance.

“Bharat suffered a fall in the course of performing the task assigned to him by Bryn, which resulted in him being rendered 100 percent disabled. Today, he is unable to perform even the most basic personal, daily chores himself and is all but 100 percent dependent on others; and as a result, though Bharat is living, he is barely alive,” the Judge observed.

Mr. Bharat, the victim, fell along with the live electricity while fixing a fault in an electricity pole on April 25, 2014.

The victim was only 21 years old back then and was not even provided safety gears like rubber gloves, ladders, etc. to perform the task.

In current times, Bharat needs total support and supervision to do any single work. He had suffered from severe back injuries and most of his days just went off by laying on the bed.
