Supreme Court refuses to Postpone NEET UG- 2021, says Court cannot Interfere

Supreme Court denied a petition brought by a group of students taking the CBSE Private, Patrachar, and Compartment exams for Class 12 requesting to postpone the NEET-UG 2021 exam, which is set to begin on September 12.

Orally, a three-Judge panel comprising Justice AM Khanwilkar, Justice Hrishikesh Roy, and Justice CT Ravikumar stated that the Court cannot interfere with the examination schedule based on the inconvenience to a group of students.

“These students should burn the midnight oil and prepare. How much can we intervene as a Court? Our indulgence means we are causing strain and pain to so many students. If authority wants to do on its own it’s for them to decide. Please don’t use our platform to push them“, the Bench orally said.

By interfering with the exam schedule, the Bench stated orally that it does not want to create confusion in the minds of the candidates.

Only 1% of students will take the improvisation exam, according to the Bench, and the entire NEET timetable cannot be modified for their sake.

The Court noted that if the authorities want to postpone the exam on their own time, they can, but the Court can’t force them to.

The Bench stated that the only relief it may award is the right to make a representation to the petitioners.

Despite the fact that a tentative date for private candidates and improvement candidates was in the public domain, the respondents failed to take notice of it before scheduling NEETUG21 on September 12th, according to the petitioners, and therefore acted in violation of the Supreme Court’s decision.

It is common knowledge that attempting an exam is not mere attendance and such a hectic schedule of exams cannot be said to be a fair opportunity. This assumes importance as NEET UG21 is held only once a year.” the plea has argued.
