Supreme Court Criticizes Centre on Tribunals Reforms Act, 2021

The Supreme Court expressed its annoyance upon the Centre’s enactment of the Tribunal Reforms Act, 2021. The Tribunal Reforms Act, 2021 has brought a reduction in the terms of members and chairman of the Tribunals. 

The Apex Court contended that the reform brought is the same as the earlier law which was struck down by the Court. The Court stated that the Centre has disrespected the Court’s directions.

The Constitutional Bench comprising N V Ramana and Justices D Y Chandrachud and L N Rao remarked that “You are emasculating the tribunals.”

The Court further questioned “Why is it taking one and half years to appoint tribunal members and chairpersons,” on the fact that the government made the appointment of 9 judges for the Supreme Court in 7 days.

The Chief Justice of India NV Ramana expressed disappointment and stated that the Court is not interested in any confrontation from the government and hence, listed the matter for further hearing for next Monday.

“We do not want confrontation with the government but we will be left with no option but to either close down the tribunals or take over the appointments and initiate contempt if the government does not implement the recommendations,” the Bench said.
