Supreme Court to Centre: Rethink about formulating Model Community Kitchen Schemes

On Tuesday, the Supreme Court directed the Union of India to consider about creating a model system for community kitchens across the country and giving additional food grains to the States in this reference. The Bench told that the logistical issues associated with the scheme will be handled by the States.

A bench consisting of the Chief Justice of India N V Ramana, Justice AS Bopanna, and Justice Hima Kohli was hearing the writ petition, which took into consideration the creation of community kitchen strategy to prevent deaths from starvation.

The Bench has allowed the State Governments to lodge Affidavits on problems such as malnutrition, starvation deaths as well as recommended changes to the Centre about the scheme. The matter has been adjourned for two weeks.

The Bench also waived the penalties that had previously been imposed on the States for the failure to file the Affidavits on time.

Further, at the outset, it was acknowledged by the Bench that according to the Union of India’s Affidavit, the Government told that it is a policy matter and the Court cannot ask the Government to take a position.

In reference to the State’s position on the issue, the CJI stated that most States told that if the Government of India offers the funds, they will provide food. He went on to say that some states are already trying to implement community kitchens and requesting funds while others aren’t. Some states haven’t put in place the schemes but are willing to do so if the Central Government offers the funds.

The Bench clearly stated that it does not mean to imply that the Government does not provide food or assistance to those in need. It insisted, however, that a model scheme can be developed.

It was made clear by the Chief Justice of India that the Court does not want the Government to develop a strict jacket strategy and added that various aspects must be taken into consideration, and thus the Centre can develop a scheme while leaving execution to the States.
