Kerala High Court orders an Inquiry for Violations by ‘Reporter TV’

The Kerala High Court on Tuesday instructed Kerala Police to investigate allegations made by actor Dileep. The news channel ‘Reporter TV’ and other media outlets violated a Trial Court order of barring media from reporting on proceedings in the Actress Sexual Assault Case in which Dileep is a main suspect.

The order was issued by single-judge bench of Justice Kauser Edappagath in response to Dileep’s request of refraining media from reporting on the trial proceedings until the final Judgement.

It was stated by Dileep in his petition that when the Trial before the Sessions Court began, there was a huge media uproar. Hence, the Petitioner moved to the Additional Sessions Judge Ernakulam for issuing an order prohibiting the publication of Court proceedings in the media.

The request was accepted by the Judge and he ordered that nobody can print or publish any proceedings in connection with the Case except those permitted by the Supreme Court in Nipun Saxena & Anr. v Union of India & Ors. But, even after the Judge’s gag order, the media published information in violation of Section 327(3) of the Code of Criminal Procedure.

This incited him to move to the High Court through lawyers Philip T Varghese, Thomas T Varghese, Achu Shubha Abraham, Litha VT, Monisha KR, and Nitya R.

In the petition before the High Court, Reporter TV was specifically mentioned, whose promoter is named as the third respondent.
