Stop Passing Orders that are Impossible to Implement: SC to High Courts

The Supreme Court directed High Courts to examine over the practicality of their orders and not to pass any order which are impossible to be implemented.

The direction comes after the Allahabad High Court directed the Uttar Pradesh government to provide 2 ambulances with ICU facilities in every village of the state.

After the Government challenged the decision stating that it was impossible for them to arrange the same within months’ time, the SC said that the high Courts must refrain themselves from dealing with issues which have trans-national ramification.

A vacation bench of Justice Vineet Saran and Justice BR Gavai also said that the direction given to the UP government must not be considered as directions, but as an advice.

In conclusion, the Supreme Court appreciated the efforts of Allahabad and other High Courts for taking up matters related to the management of the COVID-19 situation.
