SC strikes a Balance between Rights of a Mother-in-law and Daughter-in-law

The Vacation Bench of Justice Ajay Rastogi and Justice B V Nagarathna passed an order to strike a balance between the right of 80-year-old mother-in-law to stay peacefully and the right of a daughter-in-law to stay in a shared family house by asking the daughter in law to live in Lonavala and mother in law in her Vile Parle house.

The 80-year-old mother-in-law, her son and her daughter-in-law appeared through video conference in front of the Bench.

The mother-in-law pleaded that her daughter-in-law has ruined her life and she wanted to live peacefully in her Vile Parle house as the daughter-in-law is harassing her.

The daughter-in-law claimed that she was tortured for 22 years but now her in laws have started damaging her son. One of the sons is settled in abroad and the other one is a tennis player. She said she was living separately from her mother-in-law and her husband in the same house and this cannot be continued.

The Court restricted the husband when he said that everything was fine till 2018 but after that his wife became violent as it was a question on her character.

The Bench stated, “We want the old lady to have a peaceful life in the evening of her life. She should have some mental peace. But, at the same time, the daughter-in-law should have a place to stay.”

This decision was given to balance the right of mother-in-law under Maintenance and Welfare of Parents and Senior Citizen Act and of daughter-in-law under Protection of Women from Domestic Violence Act.
