SC dismissed Writ Petition filed by Mumbai City District Gym Association

The Supreme Court on Friday refused to entertain a Writ Petition preferred by Mumbai City District Gym Association challenging the election process which was notified on April 29, 2022.

A Vacation Bench of Justices Ajay Rastogi and BV Nagarathna said, You’ve failed the Bombay High Court and you come to Supreme Court? You people are politicizing the games. We don’t appreciate filing petitions against election matters.”

“Why should we entertain the petition when the HC hasn’t granted you indulgence?” the Bench further remarked.

The Counsel for the Association stated that under the terms of the letter, certain people who were not eligible were also allowed to vote.

However noting that the election program was to be held, the date for filing the nomination paper was over and that the date of voting was on June 4, the Bench in their order stated that

The present Petition questions the election of the trust which was published on April 29, 2022, and as per the election program the election is to be held, nomination papers are over & the date of voting is on June 4. The counsel for the Petitioner tried to persuade us that in terms of the letter certain people who are not eligible are also being permitted to cast a vote. We are not going to express any opinion at this stage but if the person is aggrieved by the election, he has the liberty to approach the Court.”
