SC refuses to stay Delhi HC order permitting private schools to charge annual, development fees.

The Supreme Court has refused to interfere and stay the order of the Delhi High Court allowing private unaided schools to collect annual fees and development charges from the students.

The refusal comes after the Delhi High Court’s order was challenged by the Directorate of Education (DoE) of the Delhi Government claiming that the latter had the power to regulate the fees.

The Supreme Court refused to stay the order thereby stating that since the matter is listed for hearing on 12 July by the division bench, all the contentions must be raised therein and the Supreme Court must not interfere in the same.

The order was challenged in front of the Supreme Court after a single judge bench quashed the orders of DoE regulation the fees of private unaided schools and the same was refused to be stayed by a division bench.

After the orders of DoE were quashed by the Delhi High Court, the DoE challenged the same in the Supreme Court stating that if the orders wouldn’t have stayed it will amount to complete injustice but the Apex Court had refused to stay the order.
