PepsiCo files Trademark Violation Case against Parle Agro

PepsiCo filed a trademark violation case in the Delhi High Court against Parle Agro for using the tagline ‘For the Bold’ on their newly launched product B Fizz.

The tagline ‘For the Bold’ is a registered trademark that is on the Doritos and packaged food items. 

Last year in October Parle Agro launched the B Fizz, the cans and bottles of B Fizz come with the tagline ‘be the Fizz. For the bold’ whereas PepsiCo in the year 2017 announced its production of Doritos in India which already has the tagline ‘for the bold’ and it gets manufacture in Kolkata.

PepsiCo has pleaded with the court and kept its words for Parle Agro “Infringement, passing-off, dilution and unfair trade competition” and has demanded Rs. 2 crores from Parle Agro in terms of damages.

Khaitan & Co who are representing the Parle Agro has declined to give any response by making the statement that the case is sub judice.

“Given that the issue is sub judice, it would not be appropriate to offer detailed comments,” was an email response given by the spokesperson of PepsiCo.

The Court has ordered the Parle Agro to give up a written response within a month and has fixed July 17th  as the next date for the hearing of the case.
