Madras HC Grants Interim Bail to Accused for Performing His Father’s Last Rites

The Madras High Court heard an urgent application seeking bail for an imprisoned accused on the grounds that his father had died and he, as the only son, was to perform the last rites.

On an urgent basis, Justice G. Jayachandran heard the matter.

The petitioner was on judicial remand since August 6, allegedly charged under Section 399 (Making preparation to commit dacoity) of the IPC.

The public prosecutor opposed the plea on the ground that the petitioner was earlier charged under the NDPS Act. Furthermore, he fears for his life and is concerned that a rival gang will murder him.

Further, it is submitted that the petitioner’s father’s last rites were already conducted. Hence, there is no point in granting bail to the accused.

The court, however, granted interim bail to the prisoner for 3 days, subject to his having to furnish his own bond. He has been directed to report on the completion of the permitted day and surrender before the authorities.

The police have been directed to take the petitioner to his village.
