The Madhya Pradesh High Court on February 4, 2022 rejected a Bail application of a person Accused of charges punishable under certain provisions of the Narcotics, Drugs and Psychotropic Substances Act, 1985.

The Madhya Pradesh High Court Single-Judge Bench of Justice Anjuli Palo was hearing a Bail Plea application of a person Accused under Section 8 (Prohibitions of certain operations), Section 21 (Punishment for contravention of manufactured drugs and preparations) and Section 22 (contravention involves commercial quantity) and also under certain sections of MP Drug Control Act.

The Case is pertaining to a seizure of 330 bottles of contraband Onrex Cough Syrups which was in possession of the Petitioner (original Accused). The Counsel of the Petitioner submitted that the Petitioner was falsely implicated in the Case.

Earlier, the Madhya Pradesh High Court had rejected the Plea of the applicant on June 26, 2021. As for now, the Counsel for the Petitioner submitted that the Petitioner has been in Police Custody since March 10, 2021, and pleaded for release of the Petitioner.

The Madhya Pradesh High Court Bench in light of all the facts and arguments submitted, stated that, “Looking to the increasing number of such Cases in society and its adverse effect on the young generation now-a-days, I do not find it a fit case to release the applicants on Bail.”

Thereby, the Bench rejected the second Bail Plea of the Petitioner.
