Assam Police to Gauhati HC: All guidelines issued by NHRC are being followed in Encounter Cases

In an Affidavit filed before the Gauhati High Court, the Assam State Government has informed that all procedures of Law are being followed in every Case with regard to the Police Encounters that took place since May last year.

The Affidavit informed the Court that 28 people had been killed and 73 people were injured due to the action taken by the Police, since May 10 of last year till January 28 this year.

The Assam Government as demanded by the High Court submitted a “Detailed Affidavit” on 7th February 2022.

The Gauhati High Court had sought the Affidavit to be submitted on Tuesday, 01 February, while the hearing a PIL with regard to the Encounters that took place till February 10, 2022.

Home and Political Department Additional Secretary Ashim Kumar Bhattacharyya in the Affidavit stated that, “As per the directions of the National Human Rights Commission (NHRC) the six monthly return is being executed regularly and report with reference to the same was submitted by the Assam Police last year on September 02”.

The tabled annexure submitted by the Assam Government provides detailed district wise reports of the Encounters.

The PIL filed by Advocate Arif Md Yeasin sought for Inquiry by an Independent Agency such as Central Bureau of Investigation or Special Investigation Team or any other Police Team from other States under the monitoring of the Court.

He also requested for the Judicial Inquiry by the sitting Judge of the Gauhati High Court into such incidents. Further it was sought by the PIL that Victim’s kin be paid Compensations after due verification.

Yeasin asserted in the PIL that more than 80 ‘fake encounters’ were executed leading to the death of 28 people and 48 injured Victims.

The people killed were not the ‘Dreaded Criminals’ and the Modus Operandi followed by the police has been the same.

The Petitioner had earlier filed the Complaint with regard to the ‘Fake Encounters’ with the NHRC on July 10.

The NHRC had transferred this matter to the AHRC last year, which had taken Suo Motu action on the reportedly fake Encounters and directed the State Government to submit the report with regard to the same.
