“Let Supreme Court Decide”: Madras HC on Plea to Limit Religious Significance for Clothing and Accessories in School

The Madras High Court dismissed as Withdrawn a Plea seeking to direct the Department of School Education to Prohibit pupils from wearing religiously significant clothing and accessories to schools and Educational Institutions.

A Petition submitted by Advocate K Gopinath, Leader of Hindu Munnetra Kazhagam, was being heard by a Bench of Justice M Duraiswamy and Justice T.V Thamilselvi.

The Bench stated that because the matter is already before the Supreme Court, it is unable to hear it at this time.

Gopinath claimed in his Plea that the Government of Tamil Nadu had been enforcing a Dress Code since the 1960s. It was implemented with the goal of preserving homogeneity among kids attending the same school and preventing any differences between them.

Various norms and rules governing schools and educational institutions had also been enacted by the State. One of these is the “Code of Regulation for Nursery and Primary Schools,” which specifies a dress code for boys and girls in Chapter IV Rule 14(ii).

Every school is required by law to establish a uniform dress code for all pupils enrolled in the school. The reality, on the other hand, is rather different.

He added that in most schools, students wear accessories such as hijab and other religious insignia over their clothing.

Even though Article 25 of the Constitution guarantees the Right to Religion, Gopinath claims that it is subject to reasonable limitations.

Though everyone has the right to follow their own Religion in a Secular State like India, that right should not impact other residents and should not detract from the homogeneity of the campus.

Furthermore, he believes that Religious Riots should not be allowed to spread throughout the country, particularly among school children. As a result, no one should be allowed to do anything that Violates Public Order in the Name of Religion, Culture, or anything else.
