Supreme Court to Hear Petitions Challenging Repeal of Article 370 after Summer Vacations

The Supreme Court decided to consider listing the Petitions Challenging the Centre’s intention to Repeal portions of Article 370 that granted Jammu and Kashmir special status after the summer recess.

The representations of Senior Counsel Shekhar Naphade, standing for one of the Petitioners, that the Plea demanded an urgent hearing in light of the state’s delimitation process were noted by a Bench consisting of Chief Justice N V Ramana and Justice Hima Kohli.

“This is the Article 370 matter. The delimitation is also going on,” the Senior Lawyer said.

“Let me see,” the Chief Justice of India said, adding, “This is a five-Judge matter. I will have to Reconstitute the Bench.”

After summer vacation, the Court agreed to reassemble a Five-Judge panel to hear pleas.

Several Petitions challenging the Centre’s decision to repeal Article 370 and the Jammu and Kashmir Reorganisation Act, 2019, which divides J-K into two Union Territories — Jammu and Kashmir and Ladakh — were referred to a Constitution Bench led by Justice N V Ramana by then-Chief Justice of India Ranjan Gogoi in 2019.
