Justice Hari Shankar recuses from hearing plea regarding CBSE class 10 board exams

On 28th June, Justice C Hari Shankar, part of the vacation Division Bench of Delhi High Court with Justice Subramonium Prasad recused himself from hearing a plea which had sought modification of evaluation scheme by Central Board of Secondary Education (CBSE) for class 10th board exams of 2021 based on internal assessment.

Previously, the court had issued notice in the petition, which requested that the policy for tabulating marks for the class X Board Examination, 2021, be modified based on an internal review done by the school on May 1, 2021.

The petition was filed by NGO Justice For All and moved through Advocates Khagesh B Jha and Shikha Sharma Bagga sought directions to the CBSE affiliated schools to publish on their respective website the rationale document for evaluation of class 10th students before calculation of results and uploading of them on the CBSE portal to ensure transparency so that students can access it and in time address their grievances to the board.

It was contended by the petition that CBSE had failed to protect the fundamental rights of students who had appeared for class 10th board exams in 2020-2021 under the provisions of articles 19(1)(a), 21 and 21A of the Constitution of India.

Earlier notice was issued in the petition by a Division Bench of  Justice DN Patel and Justice Jyoti Singh, which sought the reply of the Government of National Capital Territory of Delhi(GNCTD), CBSE and Ministry of Human Resource Development(MHRD).
