Fear of dying due to COVID, basis for anticipatory bail: Uttar Pradesh to Supreme Court

UP has approached SC against the order on granting anticipatory bail to those who have fear of dying of covid-19 which was passed by Allahabad HC recently.

On the surge of covid-19 cases, recently HC allowed anticipatory bail on the grounds of fear of death due to death by covid-19.

Solicitor-General, Tushar Mehta requested SC to take up the case at earliest; he citied HC giving the anticipatory bail to Prateek Jain till 2022 (130 cases being registered against him).

Prisons in India are overburdened. Requirement of decongestion is a matter concerning the health and right to life of both the prison inmates and the police personnel” latter court in SC order from earlier this month.

The SC Bench – led by Chief Justice NV Raman ordered the release of all those prisoners who were granted bail or parole last year.
