Discovery of Infidelity After Marriage Can Have Severe Impact on Women’s Well-Being: Delhi HC

The Delhi High Court, while denying bail to a man accused of abetting his wife’s suicide, highlighted that uncovering infidelity shortly after marriage can profoundly affect a woman’s mental and emotional well-being.

Justice Swarana Kanta Sharma noted that the emotional trauma of discovering a spouse’s extramarital relationship and subsequent ill treatment can push a woman to resort to extreme measures, such as suicide.

In the case at hand, the court revealed that the deceased woman had learned about her husband’s alleged extramarital affair just a day after their wedding.

Justice Sharma stressed that the shock of such a revelation can be overwhelming, particularly when a woman enters marriage with trust and hope, which are shattered by the discovery of infidelity.

Infidelity refers to the act of not being faithful to your wife or husband by having a sexual relationship with somebody else

The husband, who was accused of abetting his wife’s suicide, sought bail, claiming innocence and asserting that he had no involvement in his wife’s tragic death.

The court considered specific allegations against him, indicating that he was engaged in an extramarital affair, and that his wife was subjected to both mental and physical abuse, leading to immense stress and trauma.

Furthermore, the court examined the statement of the deceased’s mother under Section 164 of the Criminal Procedure Code (CrPC), which revealed instances of physical abuse by the accused when the deceased objected to his extramarital affair.

The court emphasized that the deceased took her own life just 13 days after their marriage.

Justice Sharma, in her ruling, concluded that there were no grounds to grant bail to the accused, considering the specific allegations and the circumstances surrounding the case.
