Delhi High Court questions West Bengal’s approach of refusing Inter-Cadre Transfer.

The Delhi High Court has questioned West Bengal’s approach of refusing the Inter-Cadre transfer requests of All India Services Officers without placing relevant material on record.

The Court dismissed a suit brought by the State of West Bengal challenging a Central Administrative Tribunal (CAT) order to relieve an Indian Administrative Officer (IAS) from the West Bengal cadre.

The official requested a change of cadre in 2016 because her spouse, an official of the Indian Forest Service (IFS) officer 2012 batch, was posted in the Uttarakhand cadre.

However, her request was rejected on 30thNovember 2016 by the State of West Bengal, stating that there is a shortage of officers.

The CAT set aside West Bengal’s order and granted 6 weeks time for passing of the necessary orders in this regard. The High Court upheld the same by taking a view that the order needs no interference.

Justice Rajiv Shakdher and Justice Talwant Singh said,“There is no dispute that Respondent no.1 was entitled to seek Inter-Cadre transfer, in terms of Rule5(2) of the Indian Administrative Services (Cadre) Rules, 1954.”
