Delhi HC allows Rajput’s Father to approach Single Judge Bench over release of Film

A division bench comprising Justices Rajiv Shakdher and Talwant Singh approved Krishna Kishore Singh, the late actor’s father, to appeal before the single judge bench which had earlier laid aside the interim application for an injunction of the film’s release.

The impugned order denying injunction was passed on June 10. The film was released on an OTT platform the next day.

The Division Bench observed that the situation has changed and hence both the parties are free to put forward their respective claims before the single bench.

During the course of the hearing, Senior Advocate Vikas Singh for the Appellant pleaded that perjury proceedings should be initiated against the Respondents for falsely submitting before the Court that the film Nyay: The Justice allegedly a self-proclaimed biopic of Sushant Singh Rajput has been released.

Vikas Singh stated, “72 minutes of advertisement? How do you show a released movie to the public as having blanks filled by ads that will be added later? This is unheard of and evasive.”

Advocate Chander Lall appeared on behalf of the filmmakers, since the single judge bench granted them the liberty the film-makers are free to release the film.

“Who are the appellants to judge the quality of my film? I did not get any ads so there are blanks. It may be a sub-standard film but that’s my cinematography. The question is, can I be restrained from showing the film on this ground?” Lall stated.

The deceased actor’s father stated that the defendants are trying to exploit the media frenzy and public curiosity surrounding SSR’s life and the circumstances surrounding his death, for their commercial gain.

Justice Sanjeev Narula had denied granting ex-parte, ad-interim injunction in the matter; subsequently, the instant appeal was preferred.
