Court grants Divorce to couple within 14 days of filing Petition

Setting an uncommon example, a Family Court in Pune has conceded Divorce to a couple within 14 days of recording Petition.

The Court allowed the Petition of the couple who filed it in a mutual decision, by forgoing the obligatory half year cooling-off period.

“Considering the facts and circumstances and the evidence on record, it is evident that due to difference of opinion and incompatibility of their temperament, they cannot live together and there cannot be a happy married life between the two petitioners. Hence, they are entitled to a decree of divorce by mutual consent,” stated Justice M R Kale while giving the Judgement.

“The marriage counsellor has filed a report which states there was no possibility of a reconciliation between the two,” added the Judge.

The Case is all about a couple seeking Divorce and they filed their Petition through lawyers Mayur Salunke and Ajinkya Salunke last month.

In their Petition, it was mentioned that the two studied in the same college in Pune and now both are software engineers.

The couple got married on December 12, 2017 under the Special Marriage Act.

“Soon after their marriage, they started having differences of opinion and constantly quarrelled even over petty things. They started living separately on April 26, 2019,” stated the Counsel.

Adding to it, Advocate Ajinkya stated that the couple share no relationship of husband and wife between them.

“The couple had settled matters relating to alimony, maintenance and stridhan as well as other issues relating to movable and immovable property. These conditions were enumerated in Amardeep versus Harveen Kaur case,” stated the lawyer.

Also, the Counsel emphasized on the point that they don’t have a child, so there are no chances of fighting for custody either.

After listening to the whole argument, the Court granted the divorce and also observed that, “The woman had waived off her right to maintenance and both the couple will not have any claim on each other’s property.”

It should be noted here that after the marriage the husband worked in Dubai and the wife worked in Pune.
