SC: Return Exam Fee for canceled Board Exams plea rejected

PLEA FOR RETURNING EXAM FEE FOR CANCELED BOARD EXAMS REJECTED

Apex Court refused to direct the State Boards to return the exam fee collected from students concerning class X and XII Board exams, which were canceled due to Covid-19 restrictions. 

A Divisional Bench of Justice Dinesh Maheshwari and AM Khanwilkar rejected the Plea, stating that the matter does not merit consideration.

The Bench supported the stand of the State Board on their inability to return the amount (exam fee), as they invested the same in the logistical arrangements and preparatory works for conducting the examination in a proper manner which ultimately could not be conducted owing to the COVID-19 restrictions.

“For the explanation offered by the boards on affidavit about their inability to refund the stated amount having spent the same for preparatory work and for making logistical arrangements for conducting the examination, which had to be canceled at the last minute, commends to us. Hence, this issue raised by the petitioners does not merit consideration”, the Bench stated.

Not long ago, the Bombay High Court had ordered the Maharashtra State Board to entertain a request made by a petitioner requesting a refund of the examination fee, as the exam could not be conducted due to COVID-19 restrictions.
