BACKGROUND- Tirath Singh Thakur was the 43rd Chief Justice of India. He started his law career as pleader in 1972. He also served as Judge of various courts of India.

After obtaining law degree, Thakur enrolled as pleader in the year 1972. He joined his father’s chamber and practiced in Jammu & Kashmir High Court. He usually dealt with criminal, taxation, civil, service and constitutional matters. After practising for almost 18 years, in 1990, he was designated as senior advocate.

Thereafter, in 1994, he was sworn in as the Additional Judge of Jammu and Kashmir High Court. Within a month, he was transferred.

Later, in the year 2008, he was appointed as the Chief Justice of Delhi High Court. On 11/08/2008, he was sworn in as the Chief Justice of Punjab & Haryana High Court.

In 2009, he was elevated as Supreme Court Judge. Thereafter, in 2015, he was appointed as the 43rd Chief Justice of India, succeeding Honourable Justice H. L. Dattu. Justice Thakur retired on 04/01/2017.

CAREER TIMELINE-

1972- In October 1972, he enrolled as pleader and practiced in Jammu & Kashmir High Court.

1990- Elevated as senior advocate.

1994- Appointed as Additional Judge of Jammu and Kashmir High Court on 16/02/1994. In the same in March, he became Judge of Karnataka High Court.

1995- He became the Permanent Judge of Karnataka High Court in March, 1995.

2004- Appointed as Judge of the Delhi High Court in the month of July.

2009- On 09/04/2008, he was elevated as Chief Justice of Delhi High Court. After few months, on 11/08/2008, he became the Chief Justice of High Court of Punjab & Haryana.

2009- Justice Thakur on 17/11/2009 was sworn in as Judge of the Apex Court of India, i.e., Supreme Court.

2015- On 03/12/2015, he became the 43rd Chief Justice of India.

LANDMARK JUDGEMENTS-

Khursheed Ahmad Khan vs. State of U. P. –

In this case, one of the employees of UP Government opted for second marriage during the subsistence of the first marriage without the permission of first wife. When it came to the knowledge of authorities, they sacked the employee. In this case, the court upheld Uttar Pradesh government’s decision of sacking its employee on grounds of misconduct.

Justice Thakur along with Justice A. K. Goel held that though as per Muslim law, a Muslim husband can have four wives but polygamy is not an integral or essential part of Islam. Further, the court said that UP Governments rules against such misconduct is not violative of Article 25 of the Indian Constitution.

State of Himachal Pradesh vs. Ram Pal –

T. S. Thakur along with Adarsh Goel in this case held that if in a case, a person accused is not able to pay the compensation to the victim or any of his family as directed by the court, then State Government is the one who has to pay the compensation to the victim. The State shall pay the compensation from funds which are available under Victim Compensation Scheme.
