Supreme Court to consider Petition for OROP in Armed Forces with automatic Revision

The Supreme Court is expected to rule on a Petition filed by an Ex-Association Serviceman’s seeking the implementation of the Bhagat Singh Koshyari Committee’s recommendation of One Rank-One Pension with automatic annual revisions, rather than the current policy of periodic review every five years.

On February 23, a Bench led by Justice DY Chandrachud reserved its verdict, asking the Centre whether the hardships of ex-servicemen could be alleviated to some extent if the periodic revision of One Rank One Pension was reduced from five years to a shorter period.

The Indian Ex-Servicemen Movement (IESM) has filed a Petition against the Centre’s One Rank One Pension formula through advocate Balaji Srinivasan.

The Supreme Court has stated that whatever decision it makes will be based on concepts rather than numbers.

It stated that when you revise after five years, the five-year arrears are not taken into account. Ex-hardships servicemen’s can be mitigated to some extent if the period is reduced from five years to a shorter period.

Senior Advocates Huzefa Ahmadi and Srinivasan, representing the Indian Ex-Servicemen Movement, stated that the Court must keep in mind that it relates to older soldiers who fought man to man, as opposed to soldiers today who have sophisticated weapons.

On July 11, 2016, the Supreme Court issued a notice on a Petition filed by IEMS through Advocate Balaji Srinivasan seeking the implementation of One Rank One Pension as recommended by the Koshyari Committee, with an automatic annual revision, rather than the current policy of a five-year periodic review.
