MP HC makes it mandatory to appoint local counsel in filing case

Madhya Pradesh High Court, in its significant decision, has made it mandatory to appoint a local lawyer for filing any case.


The High Court did so to protect the interest of local lawyers.
On the instructions of Chief Justice Sanjay Yadav, Registrar General Rajendra Kumar Wani had issued the order.


The letter filed by High Court Bar Association’s executive member Yash Soni requested the appointment of a local counsel for filing a case.


The letter stressed the violation of Section 3 under the High Court rules, 2008, during the pandemic. Under Section 3, if a party appoints a lawyer outside Indore, Gwalior, and Jabalpur, they will have to hire a local counsel.


In the pandemic, lawyers are arguing through video conference, neglecting the set provision.
