Life Sentence is Maximum Penalty that Michel can be given: CBI

As a rebuttal to the claim of alleged middlemen Christian Michel in the alleged Rs 3,600-crore VVIP chopper scam, CBI told the Special Court that, the maximum penalty that can be given to him is a life Sentence.

The relevant clauses cited by the CBI for possible Conviction of Michel are Section 13 (1) (d) of the Prevention of Corruption Act and Section 467 of IPC (Forgery of valuable Security).

Earlier Michel had contended in his Bail Plea that the maximum punishment if Convicted would be 5 years. He had also informed the Court that he was behind bars for 3 years now from when he was extradited from Dubai in December 2018.

CBI has rubbished all the claims of Michel that he was extradited by the Dubai government in lieu of India handing over Sheikha Latifa, the daughter of the Dubai ruler Sheikh Mohammed bin Rashid al-Maktoum and even Accused him of misrepresenting facts and misleading the Court.

The Court has deferred the hearing to December 15, giving time for CBI to conclude an argument.

In June, Michel’s Bail Plea in front of a lower Court was strongly opposed by both ED and CBI and eventually was turned down by the Court after remarking at him to be a ‘Flight risk’.
