Future Retail moves Delhi High Court against status quo order on deal with Reliance

Future Retail Ltd. moved the Division Bench of the Delhi High Court in an appeal against the order that directed the status quo on a deal with Reliance. 

A division bench comprising Chief Justice DN Patel and Justice Jyoti Singh stated that the matter would be heard on 4th January. 

Senior Advocate Darius Khambata, representing Future Retail Ltd urged the Bench to hear their stay application today itself, however Senior Advocate Rajiv Nayar, representing Amazon countered the request and stated that the Court procedure ought to be followed. 

A Single Judge Bench of Justice JR Midha had directed Future Retail Ltd to maintain status quo in relation to its deal with Reliance.

The court further stated the authorities must maintain status quo in all matters that are in violation of the Emergency Award passed in the dispute. 

Future Retail Ltd. was further directed to state all steps taken by it after the date of the Emergency Award.

The court also gave a prima facie finding and stated that the order was enforceable under Section 17(2) of the Arbitration Act.
