Delhi HC Orders brothers accused of beating Neighbour to perform Social Service

Delhi High Court quashed an FIR, and ordered the two brothers involved in it, to perform social service for one month at Lok Nayak Jai Prakash Narayana (LNJP) Hospital.

The FIR was registered against the two brothers at Gokul Puri police station in 2017.

The accused and the complainants are said to be relatives as well as neighbors.

The dispute between them was settled in February 2021, but the accused abused and injured the other party by an iron rod over a car parking dispute.

Justice Prasad quashed the FIR and ordered both the parties to be obligated by the terms of settlement.

The Court also ordered the accused to file a certificate of Medical Superintendent of LNJP Hospital after the completion to show the obedience.

Not only this, the Court also imposed a fine of Rs. 10,000 each on the six members of family and directed that the cost be deposited with the “Army Welfare Fund Battle Casualties”.

The Court held that “In case of any absenteeism/default or any misbehaviour on the part of the petitioners, the same shall be conveyed immediately by the Medical Superintendent, Lok Nayak Jai Prakash Narayan Hospital, to the concerned SHO, who shall, in turn, inform the learned ASC for the State, for bringing the same to the notice of the Court and for seeking recall of the orders passed today.”
