The Supreme Court is to examine whether to re-impose the death sentence for Boston Marathon bomber Dzhokhar Tsarnaev, presenting President Biden with his pledge to seek an end to capital punishment.

The court will hear an appeal of the US Justice Department filed challenging the decision of a lower court to conduct a fresh trial over the sentenced Tsarnaev should receive for the death penalty.

The justices also agreed to hear the appeal carrying out 13 executions of federal inmates filed by the Trump administration.

The court contended that since there is no clarity on how the new administration will approach Tsarnaev’s case, it will not hear the case any time soon.

During the times, when Biden served as a vice-president, the Obama administration made the initial prosecution to seek capital
punishment.
