Uttar Pradesh Bar Council Issues Revised Certificate of Practice Form – Deadline November 30, 2023

The Uttar Pradesh Bar Council has released an updated form for obtaining the Certificate of Practice. The submission deadline for this form is November 30, 2023.

Here are the general conditions associated with the form:

  1. According to the Supreme Court’s order, a High Power Committee was established to verify the credentials. In line with this order, the Bar Council of India sent a letter dated 27.09.2023 to the UP Bar Council, leading to the issuance of the following guidelines:
  2. Senior advocates designated by the High Courts and the Supreme Court are not required to complete the verification form. They should only fill out the verification form-E and submit it.
  3. Advocates registered until December 31, 1989, who had previously acquired the Certificate of Practice (COP) by completing the verification form, only need to have their COP reissued. They must complete a two-page form provided by the Bar Council of Uttar Pradesh. There is no need to attach educational certificates to the form, but a Vakalatnama is mandatory.
  4. Advocates registered after December 31, 1989, must provide educational certificates along with the re-issue form. If any advocate has obtained COP but has not yet received it, they must attach the educational form and Vakalatnama with the verification form.
  5. After filling out the form, it should be certified by the President/Secretary of the applicant’s Bar Association or a Bar Council member, Uttar Pradesh. The completed form should then be submitted to the Bar Council of Uttar Pradesh office in Prayagraj. If the applicant advocate is not a member of any Bar Association, they should provide an explanation.
  6. Along with the form, the advocate should submit any one proof such as Vakalatnama, Causelist, Case Status, Order, Questionnaire, Empanelment letter (for government and semi-government advocates), Notary letter, Oath Commissioner appointment letter, or any other registry letter, Affidavit. Only affidavits filed by the advocate related to the case for the authentication of the plaintiff/complainant will be accepted as affidavits. Additionally, self-attested photocopies of certificates issued by competent authorities can be attached for the years 2018, 2019, 2021, and 2022.
  7. If any criminal case is pending against the advocate or if the advocate has been convicted in a criminal case or has a history sheet, they should provide comprehensive details and the current status of the case in a notarized affidavit.
  8. The fee prescribed by the Bar Council of India should be paid in cash or by demand draft, made out to “Certificate And Practice Verification” and payable at Prayagraj.
  9. Photocopies of Certificate and Place of Practice (Verification) Form, Re-Issue Form, and Declaration Form are acceptable.
