Union Government Defends Newly Amended IT Rules, 2021 to Delhi HC

The Union Government has defended its amended IT [ Intermediary Guidelines and Digital Media Ethics Code] Rules, 2021, stating to the Delhi High court, that Section 3 and 4 of the Bill aims to Protect Women and Children from becoming victims of online threats such as porn revenge, circulation of vulgar content.

Previously, the Supreme court has also asked the Central Government to take action on “Frame necessary guidelines to eliminate child pornography, rape and gang rape imageries, videos, and sites in content hosting platforms and other applications”. 

An Affidavit was filed by The Ministry of Electronics and Information Technology challenging the newly amended rules on grounds such as Unconstitutionality and Antithetical to the Fundamental Principle of Democracy.

The Center has filed the Affidavit before a Bench of Chief Justice DN Patel and Justice Jyoti Sharma stating that the Rule focuses on IT service providers Collaborating with Law Enforcement Authorities to remove pictures and videos which are partially nude within 24 hours and help in finding out the Originator of the Information.

This comes in view of the Petition filed by Lawyer Uday Bedi who asserted that the New Rule Infringes the Fundamental Right of Free Speech and Privacy of the Services.
