A case has been lodged against the Director of Higher Education, Amarjeet K Sharma by the Umang Foundation which is a Charitable Trust working for the disabled.

The Case has been filed on the basis of ban imposed on person having visual and hearing impairment disabilities more than 60% for the post of school lecturer.

Ajai Srivastava, who is the Chairman of Umang and an expert member of the State Advisory Board on Disability stated that last week an advertisement was issued by Director of Higher Education.

According to him, the advertisement was about the recruitment of school lecturers in various subjects.

“It was clearly mentioned in the advertisement that the persons having visual and hearing disability more than 60% were not eligible to apply,” stated Mr. Srivastava.

Mr. Srivastava stated that this decision of the higher education is against the Rights of Persons with Disability Act, 2016, and also it violates a Judgment of the Supreme Court which was issued this year in February.

“The decision of Director of Higher Education is against the Rights of Persons with Disability Act, 2016, and blatantly violates a judgment of the Supreme Court delivered in February this year,” stated Mr. Srivastava.

“In this Judgment, the Apex Court had ruled that irrespective of degree of disability, visually and hearing-impaired persons can even Judge in the Courts. The Court has also said such disabled people should be provided with technical assistance so that they could work efficiently,” he added.

Adding to this, he also stated that though the Central Government has recognized the position of disabled in all the various field including IAS, IFS, and IRS, “The mental bankruptcy of the education department is playing with the future of the disabled persons.”

At the end, Mr. Srivastava who filed the Case, requested the State Disability Commissioner to look into the matter and order an inquiry and adding to this he stated that he would move to the High Court to seek relied, if remedial measures were not taken immediately.
