Tax Evasion Case: Delhi HC directs SGST Commissioner to file Affidavit

The Delhi High Court pulls up the State Goods and Services Tax (GST) and Central Goods and Services Tax (CGST) Officials for allegedly trying to blame each other instead of initiating appropriate action against the delinquent firms in Rs. 940 Crore tax evasion case.

The High Court noted that four different replies were filed on behalf of the CGST (East, West, North and South) and all the four Commissionerates from CGST are trying to pass on the blame to SGST.

On the last date of the hearing, the Deputy Commissioner, appearing for the SGST, claimed to have already taken action not only against the allegedly delinquent companies but also their employees.

The Deputy Commissioner added that the information was shared by them to the CGST, but they weren’t willing to take action against the remaining 202 firms out of 486 firms.

The Court noted that none was present on behalf of the Chairperson, Central Bureau of Indirect Taxes and Customs.

The Court further directed the SGST Commissioner to file an Affidavit regarding the action initiated by them in the discussed matter.
