Supreme Court upholds 27% quota for OBCs in NEET-PG counselling

The Supreme Court of India on January 7, 2022 on the hearing of the Economically Weaker Section (EWS) quota case ruled to uphold the decision regarding reservation of 27% for Other Backward Classes in counselling of applicants for Under-Graduation and Post-Graduation under National Eligibility and Entrance Test (NEET).

The Supreme Court Special Bench of Justice D Y Chandrachud and A S Bopanna upheld the reservation based on Constitutional Validity of the 27% reservation for Other Backward Classes (OBCs).

While the constitutional validity for quota of OBC’s was upheld by the Supreme Court Bench, 10% reservation for Economically Weaker Sections (EWS) category will be applicable from the academic year of 2022-2023 and the hearing for the matter regarding its Constitutional Validity will be on March 3, 2022.

Earlier a Petition had been filed which challenged a notification of the Central Government of India and Medical Counselling Committee (MCC) dated July 29, 2021. The Notification stated that there will 10% reservation for Economically Weaker Section and 27% reservation for Other Backward Classes (OBCs) in the counselling for Post-Graduate and Under-Graduate courses under the National Eligibility and Entrance Test (NEET).

The Medical Counselling Committee is now expected to release the schedule for counselling of the applicants of Under-Graduate courses and Post-Graduate courses, after the January 7, 2022 verdict of the Supreme Court Special Bench.

The January 7, 2022 verdict of the Apex Court comes as a sigh of relief for the Federation of Resident Doctor’s Association (FORDA) as the doctors had protested against the delay that had occurred in the counselling of postgraduate applicants.
