Supreme Court gives Approval for Eviction of slums for reclaiming Railway Properties

The Supreme Court gave the consent to the Indian Railways to continue with the initiated slum evictions to reclaim the railway properties.

The Bench of Justice AM Khnawilkar, Justice Dinesh Maheshwari and Justice CT Ravikumar held that solatium of Rs.2000 per month had to be paid for the demolished hut for the period of 6 months.

The Bench held the railways, state government and the local authority equally responsible to divide the burden of paying the Ordered solatium.

The Court also directed the people of slums to get into rehabilitation schemes if any had been launched by the local government.

If the local government has no such schemes launched then the people who would be affected due to demolition can apply for the allocation under the Pradhan Mantri Away Yojana (PMAY) scheme.

“Such applicants will have to be processed within 6 months of the date of the receipt”, the Bench directed.

As per the Court Order the Indian Railways can issue notices to the dwellers in the concerned unauthorized structures which are in the railway belt of Udhna and Surat and start with the new railway line project.

However, the Court has directed the collector of concerned districts to make sure that the necessary details of the people occupying the concerned structures along with their identity are supposed to be recorded.
