Supreme Court Declines Interim Stay on Delhi Government’s Challenge to Control of Services Ordinance

The Supreme Court, rejected the request for an immediate halt on the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023, issued by the Central government on May 19, 2023. This ordinance pertains to the control of services in the capital city.

The Court has issued a notice to the Centre and Lieutenant Governor in response to the Delhi government’s plea questioning the constitutionality of the ordinance. Chief Justice of India, D Y Chandrachud, and P S Narasimha, the bench members, stated that the case needs to be heard and will consider the request for an interim stay on July 17. Furthermore, the Court allowed the petitioner to include the Lieutenant Governor as a party to the petition, as they had not been initially included. A M Singhvi, the senior advocate representing the AAP government, argued for a “qualified stay.”
