Super tech to Supreme Court: Demolish only 1 tower

The Real Estate Developer Super tech Pleaded before the Supreme Court against its Demolition Order of 40-storey twin towers at its Emerald Court Housing Project in Noida, to demolish only one of the two towers.

The Towers House of over 900 flats were Ordered to be demolished over the violation of Construction By-laws.

A Bench of Justice D.Y Chandrachud and M.R Shah had in its August 31 Judgement, ordered that the Demolition of the Twin Towers should be completed within the three months and the builder has to bear the expenses for the same.

 Super tech stated that its not challenging the legality of the August 31 Judgement but only seeks a modification to save its Crore of rupees.

Super tech informed the Court that it has decided to modify the project which will also be “beneficial for the environment”. It also claimed that Demolition would leave a massive quantity of debris that will have to be dumped at a landfill site that is already overburdened.

The Court demanded to know why and how the Noida authorities, in their eternal wisdom, permitted large construction projects such as this in a designated green area.

The Court also Ordered that all the flat owners in the Twin Tower should be reimbursed with 12% interest.

The Court concluded that the sanction given by New Okhla Industrial Development Authority (NOIDA) in November 2009 for the Twin Towers was violative of minimum distance requirement and National Building Code.

The Judgement stated, “The record of this case is replete with instances which highlight the collusion between the officers of NOIDA with the Appellant and its management. The case has revealed that a nefarious complicity of the planning authority in the violation by the developer of the provisions of the law.”
