SC: Slum dwellers coming under the ambit of the Pradhan Mantri Awas Yojna Scheme for rehabilitation can approach the concerned authorities

The Supreme Court passed an order in the favor of the slum dwellers who were evicted by the government authorities two years ago from the Gandhinagar Railway station area, directing the competent authorities to assist the families with rehabilitation facilities in the state in the case of ‘Utran Se Besthan Railway JhopadpattiVikas Mandal Vs Government of India and connected matters.’

A Division Bench comprising Justices A.M. Khanwilkar and JB. Pardiwala noted that no time extension would be given to allottees by the respective authorities. However, the allottees can approach the authorities with representation asking for an extension. The court would not interfere if the authorities have the power to extend the time.

The Bench stated that it is open for applicants whose applications were denied to seek appropriate legal remedies to challenge the authorities’ orders. Finally, it was noted that the concerned Departments should take action against erring officers and that disciplinary proceedings that have already begun should be pursued to their logical conclusion.
