SC Seeks Reply From NIOS on Plea to Ascertain Determination of Exam Centre After Considering Distance Criteria

The Bench of Justice Abdul Nazeer and Justice PS Narasimha asked orally to National Institute of Open Schooling (NIOS) for response on the PIL seeking that during the determination of exam centre should be done by NIOS after considering the distance criteria.

The notice is not issued by the Bench in the matter as it is a policy decision.

“This is not adversarial. All that he’s asking is, that going far away is the question. Take instructions, it is a policy decision what is to be done. You take instructions and we will close this matter. We are not even issuing notice, get instructions, apply your mind and find a solution.”Bench said.

Firstly, petitioner went to High Court but he was asked to first go in front of the authorities where application is still pending.

The Writ Petition was filed to sought direction from Apex Court to NIOS for giving preference to nearby examination centre so the students mostly of the poor and rural background will not have to travel long distances.

The petitioner school contended that in 2014 NIOS has issued new guidelines where examination centre would be selected according to the sequence of order in scheme into 5 categories A to E.

The Guidelines further stipulated that the Regional Director should give preference according to category A to E while considering the Schools for examination centre at a particular area or place.

Kendriya Vidyalayas and other category A schools were selected as examination centre which use to be very far instead of such centers which is nearby to the school of students.
