SC Grants Last Chance to AoRs, to Dismiss Over 1000 Cases b/w 2014 & 2020 if Filing Defects Not Cured

In a recent order, the Supreme Court gave the Advocates on Record one last chance to fix the problems in the thousand or so petitions it received.

The single judge bench of Justice P. S. Narasimha, while hearing the matter in chamber, directed the respective Advocates on Record to cure the defects in the petitions and re-file them within a period of four weeks or else the case would stand dismissed, according to the order.

The batch of petitions that were filed before the apex court between 2014 and 2020 were sent back to the Advocates on Record for rectification and refiling, but the Registry has still not received the rectified copies.

The order stated, “We grant a further opportunity, as a last opportunity, we grant a further time of four weeks to cure the defects, failing which the cases shall stand dismissed without further reference to the court.”

The order also made it clear that the petitions were not returned to the registry after the defects were fixed, despite repeated reminders being sent to the counsels.

The 23 petitions from the batch were allowed to be withdrawn by Justice Narasimha.

Additionally, the registry has been instructed to notify 18 matters once more following verification, if necessary.

By order issued last month, the Supreme Court registry disposed of 13,147 cases filed prior to 2014 that still had unresolved issues.
