SC Allowed Pleas Challenging Places of Worship Act, 1991

The Supreme Court gave liberty to the petitioners who were challenging the constitutionality of certain provisions of the Places of Worship (Special Provisions) Act, 1991, to file intervention application in the pleas that were already pending.

Justices DY Chandrachud and Jamshed B. Pardiwala’s constituting Division Bench declined to tag their plea with their pending matters, saying that they could make their submissions in the main petition.

Senior Advocate Vijay Hansaria, appearing for one of the petitioners, said there were additional points that might not be entertained in the intervention application since the bench was not inclined to tag the pleas.

“Petitioner would be at liberty to supplement the submissions in the main petition”, the Supreme Court ordered.

The Act is being challenged on the grounds that it has taken away the rights of Hindus, Jains, Buddhists, and Sikhs to restore their places of worship and pilgrimages, destroyed by the invaders.

According to one of the petitions, the Act has excluded the birth place of Lord Ram but has included the birthplace of Lord Krishna, though both were the incarnation of Lord Vishnu, the creator and are equally worshipped all over the world.
