SC Affirms Delhi HC Order Constituting Hockey India CoA; Directs Expeditious Elections

The Supreme Court declined to interfere with the Delhi high court’s decision to transfer control of hockey India’s affairs to the committee of administrators (CoA) until the national sports federation’s constitution was properly amended to comply with the national impugned order.

The High Court had relied on the supreme court’s decision in the case involving the election of the executive committee of the national sports federation.

A panel made up of Justices D.Y. Chandrachund and J.B. Paridiwaladecided not to challenge the High Court’s ruling in light of the fact that the CBI has filed a formal complaint against a number of hockey India official holders.

According to the High Court’s directive, the international hockey federation (FIH) has informed the CoA that the forthcoming FIH hockey men’s world cup, slated to take place in Bhuvneshwar from January 13–29, 2023, will need to be managed by a democratically elected executive board of hockey India. The bench took this into consideration and requested that the CoA move quickly so that the election of the executive body may follow suit.

“We would like to emphasize the significance of the CoA actively engaging with the FIH to ensure that the process of amending the constitution to bring it into compliance with the high court judgement and the national sports code is concluded expeditiously and the elections are also held on an expeditious footing well in time to allow the newly elected executive committee to set up logistical arrangements for the world cup. CoA to take necessary assistance in that regard.”

The posts of life president, life member of hockey India, and CEO in the managing committee were illegitimate and out of compliance with the national sports code, the division bench of the high court remarked in the challenged ruling.

It stated that hockey India’s administrative structure had been created incorrectly or unlawfully. In this aim, a committee of three administrators was formed.
