Rule 585 of Delhi Prison Rules challenged, says Delhi HC

The Delhi High Court exhibited its dissatisfaction to increase the time given to prisoners in Delhi Prisons, to connect and consult their Advocates/family members.

A Bench comprising of Chief Justice DN Patel and Justice Jyoti Singh adjudicated the Court and heard the Public Interest Litigation (PIL) filed by Advocate Jai Anant Dehadrai challenging Rule 585 of the Delhi Prison Rules.

Chief Justice DN Patel stated, “There is no end to all these demands.”

Every prisoner is entitled to two weekly interviews with family members, relatives, friends, and legal counsel under Rule 585.

The Petition claimed that the challenged Rule restricts prisoners’ ability to plan their course of action and adequately prepare their legal defence by consulting with their attorneys whenever necessary.

Further, the Petition claimed that the current Rule violates the Right to access to Justice guaranteed under Article 21 of the Constitution.

Chief Justice DN Patel sternly replied “In Jail, there is bound to be some restrictions. If everything is available, what is the difference between Jail and in the outside world? Why go to Jail? You sit in your room only…The purpose is to cut you off from society.”

The Court highlighted that if the present demand is permitted, then later someone will come seeking 7-15 mulaqaats per week.

The Bench further adjourned the matter to 11th January 2022.

Meanwhile, the Respondents have been asked to submit their replies to the issue.
