Plea to declare Law Commission as statutory body: Supreme Court seeks Centre’s response

The Apex Court sought response of the Central government on the Law Commission Public Interest Litigation that asked for the declaration of the Law Commission as a “statutory body” and appointment of a chairperson and members to the panel within 30 days.

The notification was issued by the bench headed by Chief Justice of India SA Bobde.

The petition was filed by a BJP leader and lawyer Ashwini Kumar Upadhyay stated, “Although, on February 19, 2020, Centre approved the constitution of Twenty-second Law Commission but it has not appointed the Chairperson and Members till date.”

This plea sought a direction to the centre to appoint the chairperson and members to the 22nd Law Commission panel and alternatively prayed for the Supreme Court to the needful.

Ashwini Kumar Upadhyay also sought a direction to the law panel to consider his submission regarding the Vohra commission reports which states the alleged nexus between politicians and criminals.
