A plea in the High Court of Delhi has sought a direction for the National Crime Records Bureau (NCRB) to incorporate information on transgender prisoners in their statistics report on prisoners.
The plea filed by Karan Tripathi, through the Alliance Law Group, contended that it’s been more than six years since the Apex Court gave legal acknowledgment to transgenders, and yet the NCRB has failed to identify transgenders as a third gender in the yearly Prison Statistics India report.
By not allocating proper sex to the prison inmates – who may be transgenders, the plea stated that there could not be a guarantee of their basic human rights, thereby violating the very principles of the Indian Constitution and the Supreme Court judgment.
The plea stated:
“It is, however, interesting to point out herein that NCRB, in its other annual publications like Crimes in India and Accidental Deaths and Suicides in India, has recognised transgenders, since 2017 and 2014, respectively, as a third gender.”
The plea has argued that only two genders are presented in the report, excluding the third one.
The Ministry of Home Affairs and the Ministry of Social Justice and Empowerment are made parties by the petitioner in the plea.
