Petition filed in Supreme Court seeking Presidents Rule in West Bengal

Indic Collective Trust, an NGO has filed a petition in the Supreme Court seeking declaration of President’s rule in the State of West Bengal under Article 356 of the Constitution of India.

This plea drawn by J. Sai Deepak was filed by Advocate Suvidutt M.S. stating that the Constitutional machinery in West Bengal has completely broken down. 

“It has come to the attention of the Petitioner based on credible news reports that since the declaration of the election result in West Bengal on 02.05.2021, several miscreants and violent elements belonging to the victorious political party have wreaked havoc and have created a state of unrest by committing heinous offences of, inter alia, bombing, murder, outraging of modesty of women, arson, kidnapping, loot, vandalism and destruction of public property.” the plea stated.

The plea sought assurance for immediate arrest of the people involved in the poll violence created after the results of the Assembly elections. 

The plea further asked for directions from the Supreme Court to the Centre in order to deploy armed forces and central protection forces to restore law and order in the State.

The petitione stated that the State machinery had failed in protecting the life and liberty of its citizens.

It further stated that there was a lack of strict implementation of rules in order to prevent gatherings.

Advocate Suvidutt M.S. Highlighted the point that the violence began in the state after the results of the Assembly elections were declared on May 2 the members of the opposing political parties as well as the supporters of the All-India Trinamool Congress should be arrested immediately.

Due to the failure and neglect on the part of the State administration and police authorities in West Bengal the state has turned into a lawless zone, the petition stated.

Thus, the plea prayed that it is imperative for the Apex Court to grant urgent directions in the said matter.
